Promotion: Weekly Win Back Your Order Draw.

Prize: One weekly winner will receive a refund equal to the value of their eligible winning order, up to a maximum prize value of $500.

Draw: One winner will be selected by random draw every Thursday and contacted by email.

Open to: Australian residents aged 18 years or over who meet the eligibility criteria below.

1. Promoter

The promoter is Fewstone Pty Ltd ABN 11 885 795 792 trading as City Beach Australia ("City Beach"), Level 23, 239 George St, Brisbane QLD 4000 ("Promoter").

2. Promotion name

The promotion is called Weekly Win Back Your Order Draw ("Promotion").

3. Eligibility

Entry is open to Australian residents aged 18 years or over who have made an eligible purchase from City Beach Australia ("City Beach") and who comply with these Terms & Conditions.

Directors, Head Office management and Store Managers of City Beach Australia are not eligible to participate in this Promotion.

4. Promotion period

The Promotion runs weekly.

Each weekly entry period opens at 12:00am Thursday and closes at 11:59pm Wednesday immediately before the weekly draw, AEST time.

5. How to enter

To enter, eligible customers must:

  1. make an eligible purchase from City Beach;
  2. leave a genuine review of their purchased product or shopping experience via the review invitation, review platform, email, website review form or other review method nominated by City Beach during the relevant weekly entry period; and
  3. provide the email address or details required to match the review to the eligible order.

There is no additional cost to enter the Promotion. Any purchase required to participate must be made at the normal retail price, and internet access costs are the entrant's responsibility.

6. Review requirements

Reviews must be genuine, honest and based on the entrant's own experience.

Entry is not conditional on leaving a positive review. Positive, neutral and negative reviews are all eligible, provided they are genuine and comply with these Terms & Conditions.

The Promoter may moderate, remove or refuse to publish reviews that are offensive, defamatory, unlawful, misleading, spam, irrelevant, contain personal information, or otherwise breach the Promoter's review guidelines. Moderation of a review does not automatically affect entry, unless the Promoter reasonably determines that the review is fraudulent, fake, not based on a genuine customer experience, or otherwise ineligible.

Entrants acknowledge that the opportunity to enter the draw is offered as an incentive to leave a review.

7. Entry limits

Unless otherwise stated, each eligible order may receive one entry into the relevant weekly draw.

Multiple reviews for the same order will not create additional entries. Entries that are incomplete, fraudulent, automated, duplicated, submitted using multiple identities, or otherwise not in accordance with these Terms & Conditions may be deemed invalid.

8. Prize

Each weekly winner will receive a refund equal to the value of their eligible winning order, up to a maximum prize value of $500.

The refunded amount will be based on the final amount paid for the eligible order, after discounts, credits, returns, cancellations or refunds have been applied.

Unless expressly stated otherwise, the prize excludes any amounts not paid by the winner, gift cards or store credits used, third-party charges, additional postage costs, return postage, duties, taxes, or any fees not charged by the Promoter.

The prize is not transferable or exchangeable. The Promoter's decision regarding prize value is final, subject to applicable law.

9. Draw details

One winner will be selected by random draw every Thursday at the Promoter's premises.

The draw will include all valid entries received during the relevant weekly entry period.

If a scheduled draw falls on a public holiday or cannot reasonably take place, the draw may be conducted on the next business day.

10. Winner notification

The winner will be contacted by email using the email address linked to their eligible order or review entry within 5 business days of the draw.

The winner may be required to verify their identity, order details and eligibility before the prize is awarded.

11. Prize fulfilment

Once the winner's eligibility has been verified, the Promoter will refund the eligible winning order to the original payment method, where possible, within 10 business days.

If the original payment method is unavailable, the Promoter may provide the refund by another reasonable method.

12. Unclaimed or invalid prizes

If a winner cannot be contacted, does not respond within 7 days, is found to be ineligible, or does not comply with these Terms & Conditions, the Promoter may conduct a redraw from the remaining valid entries.

13. Returns, cancellations and refunds

If an order is cancelled, returned or fully refunded before the draw, the associated entry may be deemed invalid.

If an order is partially returned or partially refunded before the prize is awarded, the prize value will be reduced to reflect the final amount paid for the retained items.

14. Promoter's rights

The Promoter reserves the right to verify the validity of entries and entrants, and to disqualify any entrant who tampers with the entry process, submits a fake or misleading review, uses automated entry methods, breaches these Terms & Conditions, or engages in conduct that is fraudulent, unlawful or damaging to the Promotion or the Promoter's reputation.

The Promoter is not responsible for lost, late, misdirected, incomplete, corrupted or incorrectly submitted entries.

15. Privacy

The Promoter collects personal information to administer the Promotion, verify entries, contact winners and award prizes.

Personal information will be handled in accordance with the Promoter's Privacy Policy, available at https://www.citybeach.com/au/privacy-policy.html.

By entering, entrants agree that the Promoter may use their name, state/territory and review for promotional, marketing and publicity purposes, without further payment, where permitted by law.

16. Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian Consumer Law.

To the extent permitted by law, the Promoter is not liable for any loss, damage, injury, delay, technical issue, system failure or other event beyond its reasonable control arising in connection with the Promotion.

17. Changes, suspension or cancellation

If the Promotion is interfered with or cannot be conducted as planned due to causes beyond the Promoter's reasonable control, the Promoter may modify, suspend, terminate or cancel the Promotion, subject to applicable laws and any required regulatory approval.

18. Governing law

These Terms & Conditions are governed by the laws of Queensland, Australia. Entrants submit to the non-exclusive jurisdiction of the courts of Queensland.
